1. Participation

a) All information detailing how to enter this contest forms part of these terms and conditions. It is a condition of entry that all rules are accepted as final and that the contestant agrees to abide by these rules.
 
b) All the photographs must be taken within Malaysia. The cause photographed must be in line with the areas of focus of CIMB Foundation (the Foundation), i.e.
. Community Development,
. Sports and
. Education.
 
c) Each contestant is allowed only one entry for this contest. A particular cause may only be considered for funding once.
 
d) Entries:-

Entries must be registered online and submitted through the official website of the Foundation, http://mycause.cimbfoundation.com

For all categories

. Each contestant can submit up to five photographs relating to a single cause.
. The size of the image must be 800 pixels (on the wide side) and must be in JPEG format. The file size must not be more than 512Kb per photograph.
. Basic darkroom techniques eg. levels, curves, dodging, burning, minimal sharpening, colour correction are permissable.
. Black and white photos will be accepted.
. No digital super imposition/composition is allowed. Photo that shows signs of manipulation will be disqualified.
. All submission must be accompanied with a short story to describe the photographs / cause.
. Notified finalists will be required to submit high resolution image files by post on CD-ROMS by 15 August 2009. Image files not received by this date, or does not conform to the required output quality will be disqualified.
. High resolution files must be at least 3,000 to 4000 pixels at the shortest dimension, (approx. 16'' x 20'' size), and must be of exhibition quality.

Additional requirements for Student category. Each contestant must:

. Complete the field for school's name.
. Obtain a support letter from the school.
. Obtain a letter of consent from parents.


For CIMB Group Staff category, all CIMB Group staff must register using CIMB Group email address.

Incomplete entries will be disqualified.
Failure to comply with these specifications will result in disqualification.
 
e) Late, illegible, incomplete, defaced or corrupt entries will not be accepted. No responsibility can be accepted for lost entries and proof of transmission will not be accepted as proof of receipt. Entries must not be sent through agencies or third parties.
 
f) Description

A description of not more than 768 characters must be submitted together with the entry, outlining why the cause should be funded and how a grant from the Foundation will be utilised.

All descriptions must be the contestant's original creation and plagiarized entries will be disqualified.

Description may be submitted in either English or Bahasa Malaysia.
 
g) All entries are the property of CIMB Foundation. Any photograph submitted must be the work of the individual submitting them and must not have been published elsewhere or have won a prize in any other photography contest. It is the responsibility of each contestant to ensure that any image they submit have been taken with the permission of the subject and does not infringe the copyright of any third party or any laws. Each contestant warrants that the photograph is their own work and that they own the copyright for it.
 
h) CIMB Foundation shall not be liable for any disruption to the contest, whether due to technical problems or otherwise, which is beyond its reasonable control. In the event of disruption to the contest, reasonable efforts will be used to remedy the disruption and resume the contest on a fair and equitable basis to all contestants.
 
i) CIMB Foundation reserves the right to cancel, terminate or suspend the contest without any prior notice. For the avoidance of doubt, any cancellation, termination or suspension by CIMB Foundation of the contest shall not entitle the participant to any claim or compensation against CIMB Foundation for any and all losses or damages which may be suffered or incurred by the contestant as a direct or an indirect result of the act of cancellation, termination or suspension.
 
j) CIMB Foundation reserves the right to amend, delete or add to the above rules and regulation at any time without prior notice. The Foundation may in their absolute discretion refuse to accept an entry without giving any reason at any time.
 
k) These terms and conditions are governed by the laws of Malaysia.

2. Categories and Prizes

a) Open Category - general public, Malaysians and non-Malaysians aged 18 and above as at 1 January 2009 are allowed to take part.
 
b) Student Category - secondary school going children aged below 20 as at 1 January 2009. Submission must be forwarded together with a support letter by the school & consent letter from parents. The organizing committee reserves the right to verify the eligibility of the contestants under this category.
 
c) CIMB Group Staff Category – all CIMB Group staff are allowed to take part only under this category; entry under other categories will be disqualified.
 
d) Under each category, the winning cause will receive a grant of up to RM100,000 from the Foundation.

3. Assessment

a) The judging of this competition will be based on content, composition, quality, technique and creativity in the photographs in relation to the focus areas of the Foundation as well as the content of short story.
 
b) The decision of the judges is final and no correspondence will be entertained.
 
c) Winners will be notified by telephone or via email. Prizes must be collected personally.

All prize winners must have CIMB Bank / CIMB Islamic Bank account. Prize monies will be credited directly to the winners' bank accounts with CIMB Bank/ CIMB Islamic.
 
d) Prizes not collected within the given time and date will be forfeited. The Foundation reserves the right to award the prize to the next best contestant.
 
e) All prize winners will be notified to attend the prize giving ceremony. The cost of travelling will be borne by the winners.
 
f) By accepting the prize, the winner agrees that CIMB Foundation may publish:
 
(i) the winner's name
(ii) the relevant school's name (for winners of the student category)
(iii) any photograph submitted by the winner

on CIMB Foundation's website, documents and other materials (whether print or electronics).

The winner also agrees that CIMB Foundation may exhibit all the photographs submitted.

4. Ownership

a) Copyright of all images submitted for this competition shall be irrevocably granted to CIMB Foundation and their respective successors, licensees and assign the right in perpetuity to use, re-use, publish, and re-publish, and otherwise reproduce, modify and display, the photographs, and any text and information that is submitted, and name and likeness and the name and likeness of the persons depicted in the submitted photographs, in whole or in part, in connection with the photographs.
 
b) In consideration of providing any image and or any text for the Contest, each contestant grants a worldwide, irrevocable, perpetual license to CIMB Foundation to feature any or all of the submitted images in any of their publications, their websites and/or in any promotional material connected to this contest.
 
c) The owners of winning photographs shall grant the copyright of their winning photographs to CIMB Foundation, their respective successors, licensees and assigns the rights granted in this terms and conditions on behalf of the photographer and/or the persons depicted in the photographs. The owner of winning photographs represents and warrants that the photographs and/or text do not infringe any intellectual property rights or any other rights of any third parties.
 
d) All photographs for the contest will not be returned and shall remain the property of CIMB Foundation.
 
e) CIMB Foundation shall be allowed to keep, exhibit and make copies of all photographs without prior consent of or payment to any contestant for any purpose whatsoever.
 
f) Each contestant will be responsible for any talent fees incurred. CIMB Foundation will not be liable for any claims from any person as a result of this competition.

5. Risk & Liability

CIMB Foundation will not be held liable in the event of loss, personal injury, or death as a result of participation in this competition.

6. Closing Date

The closing date of this competition is 31 July 2009. All entries must be received by 5 p.m. on the closing date.

By participating in this competition, contestants agree to be bound by these rules and regulations as well as the decisions made by CIMB Foundation and the panel of judges.

If any provision of these terms and condition proves to be illegal or unenforceable, this shall not prevent the remaining provisions continuing in full force and effect.

All CIMB Group Staff are allowed to take part in this contest under the CIMB Group Staff Category only.
